Terms and Conditions of Sale – Juste Debout Cruise

1. Purpose These Terms and Conditions of Sale (TCS) govern the contractual relationship between the organizer of the Juste Debout Cruise and any person (hereinafter referred to as "the Participant") who books the cruise, whether online or through any other means.

2. Acceptance of the Terms and Conditions By booking the Juste Debout Cruise, the Participant unconditionally accepts these TCS. These TCS take precedence over any other document unless there is a prior, explicit, and written agreement from the organizer.

The Participant acknowledges that they have read and understood these TCS before finalizing their booking. In accordance with French consumer law, the Participant has a right of withdrawal of 14 days from the date of booking unless the reservation is made within 30 days of departure. This right of withdrawal does not apply to transportation, accommodation, or leisure services provided at a specific date as per Article L. 221-28 of the French Consumer Code.

3. Pricing and Reservations Prices are listed in euros, including all taxes (VAT included). Prices are subject to change at any time without prior notice. Reservations are considered final only after receipt of full payment or validation of the first installment in the case of a payment plan.

The organizer reserves the right to adjust prices in the event of changes in applicable taxes, exchange rates, or third-party service costs. Payments made in installments must comply with the agreed schedule, and any delay will result in a penalty of 10% of the overdue amount. Failure to pay any installment within the agreed timeframe may result in the cancellation of the reservation without refund of amounts already paid.

4. Payment Terms Payment for the cruise can be made in full or in multiple installments through secure payment platforms such as PayPal or Stripe (subject to availability). The organizer reserves the right to cancel the booking if any payment is missed within the agreed schedule. All payments are final, and no partial refunds will be issued for services not used by the Participant.

5. Cancellation and Refunds

5.1 Cancellation by the Participant: Any cancellation must be submitted in writing to the organizer and justified with valid reasons such as severe illness, the death of a close family member, or similar unforeseen events, supported by official documents (e.g., medical certificate, death certificate). Cancellation fees are as follows:

• More than 90 days before departure: Refund of 25% of the total amount.

• Between 89 and 60 days before departure: Refund of 10% of the total amount.

• Less than 60 days before departure: No refund.

No refund will be granted for cancellations without valid reasons or if supporting documents are not provided within the specified timeframe.

5.2 Cancellation by the Organizer: In case of cancellation by the organizer for reasons other than force majeure, a full refund will be issued. In the event of force majeure (including but not limited to epidemics, pandemics, extreme weather conditions, acts of war, strikes, or any other unforeseeable circumstances), the organizer may offer a rescheduled date or a credit voucher instead of a refund. If the Participant refuses both options, a refund may be issued, minus any non-refundable costs already incurred by the organizer.

5.3 Non-Refundable Items: Add-on services such as insurance, visa fees, or other third-party services are non-refundable. The Participant is responsible for ensuring that these items are covered by their insurance policy.

6. Force Majeure and Weather Conditions The organizer is not liable for non-performance of contractual obligations due to force majeure or adverse weather conditions. This includes, but is not limited to, natural disasters, epidemics, pandemics, acts of war, or unforeseen governmental decisions. In such cases, no compensation or indemnity will be due to the Participant, although a reschedule or credit voucher may be offered. If the Participant refuses both options, a refund may be issued, minus any non-refundable costs already incurred by the organizer.

7. Cruise Modifications The organizer reserves the right to modify the itinerary, program, or participants of the cruise for safety reasons, in case of force majeure, or if required by external circumstances. Minor modifications will not entitle the Participant to any refund or compensation. In the case of substantial modifications (such as changes in departure dates, removal of key destinations, or replacement of headline performers), the Participant may choose to accept the changes or request a partial refund proportional to the services not provided.

8. Liability

8.1 Organizer's Liability: The organizer is only liable for direct and foreseeable damages caused by the improper performance of contractual obligations. The organizer is not liable for indirect or unforeseeable damages, including loss of profit, enjoyment, or reputation. The total liability of the organizer, regardless of the nature of the damage, shall not exceed the total amount paid by the Participant for the cruise.

8.2 Participant's Liability: The Participant is responsible for any damage caused by them to themselves, other participants, staff, or the organizer's property. Any inappropriate behavior or violation of safety rules may result in the immediate exclusion of the Participant from the cruise without refund. The Participant will also be responsible for covering any costs related to repairs or replacements.

8.3 Third-Party Services: The organizer acts solely as an intermediary for services provided by third parties, such as the cruise company, excursion providers, and other external suppliers. The organizer shall not be held liable for any issues or damages arising from services directly provided by these third parties.

8.4 Theft, Loss, or Damage: The organizer is not responsible for theft, loss, or damage to personal belongings, including dance equipment and other items. Parents or legal guardians are responsible for supervising their children on board, and the organizer declines any liability in case of incidents involving minors.

9. Stopovers and Delays During stopovers, it is the Participant’s responsibility to adhere to the return times specified by the organizer. In case of delay at a stopover, the ship will depart as scheduled. The Participant will then be responsible for making their way to the next port of call at their own expense. The organizer is not liable for any consequences of the Participant’s delay.

10. Insurance The Participant is required to purchase travel insurance covering medical expenses, repatriation, cancellation, and risks related to epidemics, adverse weather, and stopover delays. The organizer reserves the right to refuse boarding in the absence of valid proof of insurance. The organizer declines all responsibility for accidents, illnesses, or loss of personal belongings not covered by the Participant’s insurance.

11. Data Protection Personal data collected during the booking process is processed in accordance with French data protection regulations (GDPR). This data is used exclusively for managing reservations and is not shared with third parties without the Participant’s consent.

12. Governing Law and Disputes These TCS are governed by French law. In the event of a dispute, and after an attempt at amicable resolution, the Participant may contact an accredited consumer mediator before pursuing legal action. If the dispute is not resolved, the competent courts will be those located at the organizer’s registered office.

14. Additional Provisions

• Health Protocols: Participants must comply with any health protocols in place at the time of the cruise, including but not limited to vaccination or testing requirements.

• Payment Defaults: In case of non-payment or late payment of any installment, the organizer reserves the right to cancel the reservation without notice and without refund of amounts already paid.

• Age Restrictions: Minors must be accompanied by a parent or legal guardian who will be responsible for their supervision at all times.

• Right to Refuse Service: The organizer reserves the right to refuse or exclude any Participant whose behavior disrupts the enjoyment of others or jeopardizes the safety of participants or staff. No refund will be granted in the event of exclusion for disciplinary reasons.

• Non-Responsibility for Third Parties: The organizer shall not be held liable for any delays, cancellations, or other issues caused by third-party service providers such as airlines, transportation companies, or hotels.

Conditions Générales de Vente – Juste Debout Cruise

1. Objet

Les présentes Conditions Générales de Vente (CGV) régissent les relations contractuelles entre l’organisateur de la Juste Debout Cruise et toute personne (ci-après dénommée "le Participant") procédant à une réservation de la croisière, qu'elle soit en ligne ou par tout autre moyen.

2. Acceptation des Conditions Générales

Toute réservation de la Juste Debout Cruise implique l'acceptation sans réserve par le Participant des présentes CGV. Ces CGV prévalent sur tout autre document, sauf dérogation préalable, expresse et écrite de l’organisateur.

3. Tarifs et Réservations

Les prix sont indiqués en euros, toutes taxes comprises (TTC). Les tarifs sont susceptibles d'être modifiés à tout moment. Les réservations ne sont considérées comme définitives qu'après réception de l'intégralité du paiement ou après validation du premier paiement dans le cadre d'une option de paiement échelonné.

4. Modalités de Paiement

Le paiement de la croisière peut être effectué en une seule fois ou en plusieurs fois sans frais via les plateformes de paiement sécurisées PayPal ou Stripe (sous réserve de disponibilité). Le paiement échelonné est soumis à l'approbation par l'organisateur et à la validation des conditions de la plateforme de paiement choisie.

5. Annulation et Remboursement

• Annulation par le Participant : Toute annulation doit être notifiée par écrit à l’organisateur et être motivée par des raisons sérieuses, telles que maladie grave, décès d'un proche, ou autre événement similaire, avec preuves à l'appui (certificat médical, acte de décès, etc.). Les frais d'annulation sont les suivants :Annulation jusqu'à 90 jours avant le départ : remboursement de 50% du montant total. Annulation entre 89 et 30 jours avant le départ : remboursement de 25% du montant total. Annulation à moins de 30 jours du départ : aucun remboursement.

• Annulation par l’Organisateur : En cas d'annulation de la croisière par l’organisateur pour des raisons autres que la force majeure, un remboursement intégral sera effectué. En cas de force majeure (incluant, mais non limité à, des épidémies, des pandémies, des conditions météorologiques extrêmes, des actes de guerre, des grèves, ou toute autre situation imprévisible), l’organisateur peut proposer une nouvelle date ou un avoir sans remboursement.

6. Force Majeure et Intempéries

L’organisateur ne pourra être tenu responsable pour tout manquement à ses obligations contractuelles en cas de force majeure ou d’intempéries. Cela inclut, sans s’y limiter, les catastrophes naturelles, les épidémies, les pandémies, les actes de guerre, ou les décisions gouvernementales imprévues. En cas de survenance d'un tel événement, aucune indemnité ou compensation ne sera due au Participant, qui pourra toutefois bénéficier d’un report ou d’un avoir selon les conditions proposées par l’organisateur.

7. Modification de la Croisière

L’organisateur se réserve le droit de modifier l'itinéraire, le programme et les intervenants de la croisière pour des raisons de sécurité, en cas de force majeure, ou si les conditions de vie ou autres l'exigent. Ces modifications ne donneront droit à aucune compensation ou remboursement, sauf décision contraire de l’organisateur.

8. Responsabilité

• Responsabilité de l’Organisateur : L’organisateur n’est responsable que des dommages directs et prévisibles causés par la mauvaise exécution des obligations contractuelles. Il n'est pas responsable des dommages indirects ou imprévisibles, ni des pertes de bénéfices, de jouissance, ou de réputation.

• Responsabilité du Participant : Le Participant est responsable des dommages qu'il pourrait causer à lui-même, aux autres participants, au personnel ou au matériel de l’organisateur. Toute conduite inappropriée ou non conforme aux règles de sécurité peut entraîner l'exclusion immédiate du Participant de la croisière sans remboursement, ainsi que des frais à la hauteur des sommes nécessaires à leur restauration / remplacement.

• Vols, Pertes, Détérioration et Enfants : L’organisateur décline toute responsabilité en cas de vol, perte, détérioration de biens personnels, y compris les équipements de danse et autres effets personnels. Les parents ou tuteurs légaux sont responsables de la surveillance de leurs enfants à bord. L’organisateur décline toute responsabilité en cas d’incident les concernant.

9. Escales et Retards

Lors des escales, il est de la responsabilité du Participant de respecter les horaires de retour à bord indiqués par l’organisateur. En cas de retard du Participant au point de rendez-vous à une escale, le navire partira selon l’horaire prévu. Le Participant devra alors prendre ses dispositions pour rejoindre le navire à la prochaine escale, à ses propres frais. L’organisateur décline toute responsabilité en cas de retard du Participant ou de ses conséquences.

10. Assurances

Il est fortement recommandé au Participant de souscrire une assurance voyage incluant les frais médicaux, le rapatriement, l'annulation, ainsi qu'une assurance spécifique pour les risques liés aux épidémies, aux intempéries, et aux retards aux escales. L’organisateur décline toute responsabilité en cas d'accident, de maladie, ou de perte de biens personnels non couverts par une assurance.

11. Protection des Données

Les données personnelles collectées lors de la réservation sont traitées conformément à la législation française en vigueur sur la protection des données (RGPD). Elles sont utilisées exclusivement pour la gestion des réservations et ne sont pas partagées avec des tiers sans le consentement du Participant.

12. Droit Applicable et Litiges

Les présentes CGV sont régies par le droit français. En cas de litige, et après tentative de résolution amiable, les tribunaux compétents seront ceux du lieu du siège social de l’organisateur.
